Terms of Service

These Terms of Service (“Terms”) govern your use of harishjaiswal.com and the services offered by Harish Jaiswal Photography (“HJP,” “we,” “us”), including photography services and The Content Club NYC monthly content subscription. By using this website or purchasing our services, you agree to these Terms.

1. Services

HJP provides professional photography services (portraits, headshots, events, weddings, and commercial work) and The Content Club NYC, a monthly social media content subscription for businesses. Specific engagements may be governed by a separate signed agreement; where a signed agreement exists, it controls over these Terms.

2. Content Club — Plans, Billing & Term

The Content Club NYC is offered in monthly plans (currently Starter — 15 posts per month, and Growth — 25 posts plus 4 short-form videos per month). The plan you select at checkout constitutes your selected plan under these Terms. Plans are billed monthly in advance by recurring subscription through Stripe. Following the first month of service, plans carry a minimum committed term of three (3) months of paid service, after which the subscription continues month-to-month. Either party may cancel effective at the end of the then-current billing period with written notice (email is sufficient). We may pause deliveries for accounts more than 7 days past due.

3. Scope; Additional Posts

Each plan includes only the deliverables listed for that plan. Custom work, revisions beyond one round of reasonable adjustments per delivery, strategy services, posting or scheduling to your accounts, and community management are not included. Additional posts beyond your plan quantity are available at $25 per post, invoiced separately.

4. First-Month Guarantee — No Refunds

The first month of a Content Club subscription is covered by our satisfaction guarantee: if you are not satisfied with your first month’s delivery, your second month of service is provided at no charge. This guarantee is the sole and exclusive remedy for first-month dissatisfaction. We do not provide refunds. All fees are non-refundable once billed.

5. Client Materials & Delivery

Content Club clients provide 2–4 photographs of their products, space, or services by the 25th of each month; completed content is delivered by the 1st of the following month via a shared digital folder. Late-arriving materials may result in a correspondingly delayed delivery for that month.

6. Production Methods

Content Club deliverables are produced using a combination of professional photography and AI-assisted production tools. By subscribing, you consent to this production method.

7. Ownership & License

Upon payment, clients own delivered content and may use it for their business marketing without restriction. You represent that you have rights to all materials you supply to us, and you grant us a license to use those materials solely to produce your deliverables. We display client work in our portfolio or marketing only with the client’s prior written consent.

8. Acceptable Use

You may not use our services to create or distribute content that is unlawful, infringing, deceptive, or harmful. We may decline any request that we reasonably believe violates law or these Terms.

9. Disclaimers & Limitation of Liability

Services are provided “as is.” We do not guarantee any specific marketing outcome, engagement level, or revenue result. To the maximum extent permitted by law, our total liability arising from or relating to the services is limited to the fees you paid us in the one (1) month preceding the claim, and neither party is liable for indirect, incidental, or consequential damages.

10. Changes

We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the website or services after changes take effect constitutes acceptance.
