Terms of Service

These Terms of Service (“Terms”) govern your use of harishjaiswal.com and the services offered by Harish Jaiswal Photography (“HJP,” “we,” “us”), including photography services and The Content Club NYC monthly content subscription. By using this website or purchasing our services, you agree to these Terms.

1. Services

HJP provides professional photography services (portraits, headshots, events, weddings, and commercial work) and The Content Club NYC, a monthly social media content subscription for businesses. Specific engagements may be governed by a separate signed agreement; where a signed agreement exists, it controls over these Terms.

2. Content Club — Plans, Billing & Term

The Content Club NYC is offered in monthly membership plans (currently Essentials, Growth, and Authority), each with the deliverables, shoot cadence, and monthly content quantities described on our website at the time of purchase, and a one-time Content Sprint engagement (one shoot, ten finished pieces). The plan you select at checkout or in writing constitutes your selected plan under these Terms. Plans are billed in advance by recurring subscription through Stripe, monthly or as a prepaid three-month quarter. Memberships carry a minimum committed term of three (3) months of paid service, after which the subscription continues month-to-month. Either party may cancel effective at the end of the then-current billing period with written notice (email is sufficient). We may pause deliveries for accounts more than 7 days past due.

3. Scope; Revisions

Each plan includes only the deliverables listed for that plan. Revisions are included up to two (2) rounds of reasonable adjustments per monthly delivery, with a 48-hour turnaround target. Custom work beyond your plan, posting or scheduling to your accounts, paid advertising management, and community management are not included. Additional deliverables beyond your plan quantity are quoted and invoiced separately.

4. First-Month Guarantee — No Refunds

The first month of a Content Club subscription is covered by our satisfaction guarantee: if you are not satisfied with your first month’s delivery, your second month of service is provided at no charge. This guarantee is the sole and exclusive remedy for first-month dissatisfaction. We do not provide refunds. All fees are non-refundable once billed.

5. Shoots, Client Property & Delivery

Membership content is produced from photography sessions conducted at our Midtown Manhattan studio or, where included in your plan, at your location. Clients may attend studio sessions or drop off and collect their products the same day. We exercise reasonable care with all client property in our possession; our liability for loss of or damage to client property is limited to the value declared by the client in writing prior to the session, or in the absence of a declaration, to the limits of our applicable insurance coverage. Completed content is delivered monthly via a shared approval board. Delays in providing products, approvals, or required materials may result in a correspondingly delayed delivery for that month.

6. Production Methods

Content Club deliverables are produced using a combination of professional photography and AI-assisted production tools. By subscribing, you consent to this production method.

7. Ownership & License

Upon payment, clients receive a perpetual, worldwide license to use delivered content for their business marketing without restriction. We retain ownership of raw files and our production archive, and the right to display delivered work in our portfolio and marketing; clients may opt out of portfolio use by written request. Upon cancellation, clients retain delivered content; undelivered work-in-progress and raw materials remain ours. You represent that you have rights to all materials you supply to us, and you grant us a license to use those materials solely to produce your deliverables.

8. Acceptable Use

You may not use our services to create or distribute content that is unlawful, infringing, deceptive, or harmful. We may decline any request that we reasonably believe violates law or these Terms.

9. Disclaimers & Limitation of Liability

Services are provided “as is.” We do not guarantee any specific marketing outcome, engagement level, or revenue result. To the maximum extent permitted by law, our total liability arising from or relating to the services is limited to the fees you paid us in the one (1) month preceding the claim, and neither party is liable for indirect, incidental, or consequential damages.

10. Changes

We may update these Terms from time to time. The “Last updated” date above reflects the current version. Continued use of the website or services after changes take effect constitutes acceptance.
